The October trial date for "patent nullification" is just a little more than 2 months away. I wonder if Lexar is serious about proceeding and what they are going to do if the IPO flops. Operationally they are bleeding red ink and continuing to pursue this case (with all the attendant risks which include the potential for treble damages related to "willful infringement") could spell insolvency for Lexar.

If you read the section in the SEC registration statement about Sony you will see that Lexar management went so far as to say that the licensing/manufacturing arrangement would be dissolved if one or both parties went bankrupt. Somehow I don't see Sony filing for Chapter 11 just yet.

If I were in on the IPO roadshow I would ask...

1) You seem to have some interesting patents in the controller arena. Are you still able to negotiate a cross-licensing deal with SanDisk and why aren't you actively pursuing this avenue?

2) Does the infringement judgement against you affect the design of the Memory Stick controller you are developing for Sony?

3) How far along are the contingency plans? When will the redesigned CompactFlash controller be ready for full-scale production?

4) Why did all you guys leave SanDisk in the first place?
Those guys are blowing the roof of the flash card market!!!

SanDisk to pursue an alternate marketing angle.

It appears that SanDisk will be installing self-serve, high resolution photo kiosks at strategic POS locations at affordable prices (Hello Kodak!!!) to help promote the brand name. Lexar Media, on the other hand, decided to enter an already crowded on-line photo developing market.

Aside from Kodak, I have not seen other photo kiosks around town. I believe Kodak uses a dye sub printer which gives OK results. The damn things cost $7.95 and up per page, though and there is no CF or SM slot or options for printing 4 x 6 images!!! SanDisk seems to have picked an excellent partner which will be able to provide a silver halide process and (hopefully) dedicated CF and SM slots.

I will be psyched up to walk into a mall and see the SanDisk logo on a kiosk!
