My position on limiting attorney fees, in most cases, has the undesireable effect of limiting access to the justice system. Shortly after the end of the Civil War, a law was passed limiting attorney fees to $10.00 for helping a veteran with a disability claim. The law was repealed only a few years ago. When people read about huge attorney fees, they do not think about the huge costs and huge amount of time involved. They only see the gross amount. I have not thought about punitive damages awards being paid to the state. In my state, Washington, we do not have punitive damages. I am not necessarily opposed to the idea.
