As long as the SEC continues to grant confidential status to almost anything a company wants to classify as confidential, in required SEC filings, a significant amount of important information will be kept from shareholders but not from management, and corporate employees nor SEC staff.

Without updates and hints to analyst this store of information will become even more valuable. When the price of a commodity goes up more will be willing to sell the information to others or use it themselves. While there are legitimate reasons for not disclosing the terms of agreements the SEC could at least impose a reporting burden by requiring a detailed explanation of how and why disclosure would damage the competitive position of the company.
