The employee doesn't face the same risks as the investor.

I don't agree with this.

When you go to a startup company, the lower the financing level the more stock you get - its all about risk in the same way investing is about risk. The capital is different - human capital vs. $$, but in this climate human capital is worth more.

Just call up accel, Kleiner Perkins or literally any VC and see if they want 1) your money as an investor, 2) your human capital as a worker. They don't want your money, they have more than they can handle of that.

I'm just saying I see this as an unfair bias which flies in the face of proposals for a "flat tax" or tax cuts etc.
