The Constitution is silent regarding abortion. You can argue for not banning based on what you see as the rights of the mother or argue for banning based what you see as the rights of the child, but the Constitution will not support you. I suppose that since banning it is not a power granted to the federal government, constitutionally the issue would be for the states to decide.
