The Declaration of Independence says:

"We hold these truths to be self evident. That all men are created equal and endowed by their creator (God) with certain inalienable rights."

Any student of history understands that this country was founded on the idea that our rights and property rights come from God not the State. In contrast to this was the Divine Right of Kings which held that God acted through the King. A sort of infallibility doctrine.

By declaring that rights came from God, the founding fathers tried to create rights that the State would not be able to take away.

Of course, the Supreme Court has emasculated many of these rights.
