This risk arises from vertical integration. SDL is one of the largest suppliers of this type of laser and JDSU is one of largest suppliers of the chips used to build them. Together, they would exercise enormous power over the whole supply chain, from raw components to the packaged products bought by equipment manufacturers.

This threatens to make life difficult for other manufacturers of pumped lasers like Nortel Networks Corp. (NYSE, TSE: NT) , Lucent Technologies Inc. (NYSE: LU), and Corning Inc. (NYSE: GLW), all of whom buy some of their pumped laser chips from JDSU.

These same giants who are complaining about having a sole-source are also worried about making this source their enemy.

I'd love to be a fly on the wall in some of these corporate boardrooms. :)

I'd also like to be a second-source supplier.

Pat

Can we theorize on the DOJ 30-day comment period?

Merger announced on 7/10/00

CC comments re: filing within a couple weeks would put the file date at 7/24/00 approximately.

Today marks 30 days from that hypothetical file date.

I'm guessing we'll get some comment within a week --- two weeks at most.

Comments?
