JDS Uniphase (JDSU: news, msgs) and SDL (SDLI: news, msgs) said they intend to respond promptly and fully to the request by the Justice Department antitrust division. The companies said they still intend to complete the merger in the fourth quarter.

So-called "second-request reviews" by regulators are rare, but not unexpected in deals that could foster significant concentration in an industry.

The companies announced last month that JDS Uniphase would acquire SDL in a stock swap. SDL shareholders would get 3.8 shares of JDS Uniphase for each share of SDL.

Ontario-based JDS Uniphase designs and manufactures products used in the fiber optic communications markets, while SDL products power data, voice, video and Internet information over fiber optic networks.

Shares of JDS Uniphase closed up 2 1/8 to 125 1/8 Thursday. SDL shares rose 2 1/8 to 125 1/8.
