I think the overall ethics of this type of situation was presented well in a Star Trek NG episode. Wesley Crusher stepped on a cucumber frame, but the society where he did so proscribed the death penalty for infractions, no matter how minor.

After years of badgering it is no surprise that Clinton eventually had one infraction of deception. It did not call for the political death penalty. Especially when you consider that the years of badgering turned out to be over nothing.
