Lawsuits like that are often both a positive and a negative. By that I mean a few things: (1) RMBS probably has at least an arguable basis for doing what they did, or they wouldn't have tried; (2) given that, there is some chance that the lawsuit will be unsuccessful; (3) antitrust cases in the kind of market we are talking about here are very hard for the plaintiff to win; (4) the mere fact that the lawsuit was brought suggests that the spoils which go to the winner will be significant; (5) in most lawsuits, there is no winner (except the lawyers <g>) -- what happens is that the parties spar and posture and blow smoke for awhile and then everybody realizes that it's a big risk to let the winner take all and they settle.

If you look at the possible scenarios, many of them will leave RMBS in an ok position, a couple would leave RMBS in a strong position, and a couple would leave them in a weak position. I think the market will forget about this suit in a couple of days (the trough of that period will be a short term buying opp), and then RMBS will resume it's hyperactive fluctuations until news comes out of the court several months from now.

JMHO -- haven't read anything but the press story on the suit, and have no current position in RMBS...
