There is a difference between patents and trade secrets. The latter are things like potential advertising and promotional campaigns, customer and potential customer lists, ongoing and past research projects, and so forth. A patent is a public document and the only question is whether a certain use infringes upon in. In addition, the trade secrets case is pending in a state court in California and all patent cases are heard in federal court (this one being in Delaware). The fact that the state court appointed a monitor to me just seems to indicate that the court took a middle of the road view. It permitted BRCM to hire the former INTC employees over INTC's protests but appointed someone to monitor the situation to insure that no harm was done. Hope this helps.
