Both suits seem to me to be because of RMBS's higher royalty for DDR. I think Micron & Hyundai suits will end up in RMBS favor likely around Oct. maybe Nov. at latest. My reasoning is that Micron has a big stake with AMD and Via (Taiwan) to get DDR ready for AMD's Athalon to compete with Intel's P4. If Micron doesn't resolve situation it seems to me that AMD will be at a huge competitive disadvantage to the P4. Right now RDRAM production is ramping up, RDRAM prices are dropping, the P4 is close to release and many OEMs will be reluctant to stock new DDR from Micron with a lawsuit hanging. Plus there is the Sony Playstation II release in October in the USA and heavy advertising should start in the 1st half of Sept. so RMBS is gaining a lot of momentum in my opinion. Therefore I think MU will be forced to settle shortly or Intel's P4 gets away from AMD and Athalon fails in the high performance PC marketplace. The stakes are very high for Micron, AMD, VIA and Hyundai! Everything looks positive to me for RMBS as finally all the pieces are coming together. I was all geared to buy more RMBS the morning after the MU lawsuit was announced but RMBS did not drop enough so no more added. I suspect RMBS will drive a very tough bargain and spare no quarter to stick it to the bastards!

Also be aware that both Samsung (largest DRAM manufacturer & NEC the #4 DRAM producer) seem to be very happy with RMBS and have said some very nice things recently. Also the RMBS executive spearheading the contract negotiations is a former Samsung executive. I wouldn't be a bit surprised if RMBS already has in hand an understanding or agreement with Samsung & NEC. We shall soon see I suspect. The problem with waiting to enter RMBS now is that RMBS could announce another contract or a settlement of any of the three lawsuits any day.
