jkernan - it's not easy to take something like that up as you suggest. The possibility for countersuit is there, bringing with it the possibility of subpoena-ing all trading records, phone logs, bank account records, and records of all internet communications with the public that he is supposed to be keeping. This might put him personally at risk, professionally at risk, and could put both his dealership and hedge fund at risk - and one of the recommended remedies for brokers breaking the law is disgorgement: Taking back the money that was lost to the criminal during the crime. Then there is always the possibility of punitive damages, etc.

By taking-up such as you suggest, he not only puts himself at risk but may, by extension, put his clients at risk. But this is the risk he assumed when he began this masquerade.

JDSU is the best example that Auric's sense for (over)value is not limited to small stocks but also to bellwethers - stocks which are definitely impossible to manipulate.
