About 6 weeks ago, I sent a letter to

our trade representative, Ambassador Barshevsky, complaining of the unfairness of European policies concerning 3G standards. Here is the response that I just got:

Dear Paddles:

Thank you for your recent letter expressing concern about third generation standards affecting competition in the EU telecom market. My staff has been actively engaged with the Europeans over the issue and we are monitoring developments. Let me take this opportunity to apprise you of some of our efforts.

When the U.S. initially expressed concern about the European Commission's decision to mandate licensing only to third generation standards selected by the European Technology Standards Institute (ETSI), the European Commission insisted that a uniform standard was necessary to permit roaming and that ETSI was an open process. USTR repeatedly raised with various European Commissioners the US concern about the possibility of the EU adopting a single, mandatory standard for third generation wireless equipment and services, or by taking other steps that would effectively promote a particular standard. Commissioner Bangemann wrote Ambassadour Barshefsky noting that EU Member States would only reserve one license for the ETSI standard and other licenses could be awarded to any of the other four standards recognized by the ITU. Present Enterprise and Information Society Commissioner Liikanen has reaffirmed this policy to USTR in writing.

My staff has remained vigilant in monitoring the European Member State process of awarding licenses to ensure that the Europeans do not backslide on their promises. We have raised concerns with several Member States, and we have noted a change of policy as a result. Thank you for your concern.

Mark Roberts talked about this very result back in April, I think. However, I do not ever remember the definative results being announced. Well here you have it. Q's standard will not be legally proscribed.
