That is precisely what Neal said they were going to be doing during the conference call. I don't know how much of Nichia's IP relates to using GaN as the diode, and how much relates to the sapphire substrate. It would seem that the use of SiC is an extension of prior art that is nonobvious and patentable. I called CREE yesterday and talked to their patent lawyer (Fran was out). He said that the decision between Toyoda and Nichia was just between those two companies, and did not affect the suit that CREE is intervening in between Sumitomo and Nichia. I am not worried. Worst case--they pay Nichia a license fee (IMO).
