Dave, my theory is that Micron will contend that the IP revolving around RDRAM is different from the IP revolving around SDRAM and DDR. Then if Rambus gives favorable SDRAM and DDR licensing terms to Intel because of the "balanced benefit" of RDRAM development, Micron will call foul. They'll contend that Rambus is trying to kill off a competing technology in favor of their own technology by abusing their patents.

I don't know if there is any regulation regarding the "fair use of patents." However, I still think Micron is basing their case on arguments that revolve around the undefined gray areas between what is legal and what isn't. And considering that most of their bread-n-butter is at stake (because Micron doesn't want to pay a measly 1-3% in royalties), I think there's a strong chance Micron will eventually settle.
