Funny thing is, they instantly put offers on the table to settle--no cash or damages involved--with each of us for simply agreeing to refrain from posting on the ELN Yahoo board. To my knowledge, 2 of the 11 have settled under those conditions. The remaining 9 (myself included) are evaluating our options, which may include countersuits...the discovery process could get really nasty for CS First Boston ("Wall Street Uncovered"??? I suspect seeing their client trades in ELN and comparing them with the timing of CSFB's 16 reiterate hold calls might be an eye-opening proposition).

There are also jurisdiction questions...a bunch of New York attorneys coming down to Louisiana to sue little ol' me might not go over so well with a jury of 12 Louisianians. You know, we don't take too kindly to 'northerners' down here, LOL.

Regardless, my defense is pretty easy...I put a 5-month chart of ELN up on a 36" x 24" easel, show it to the jury, and admit that I called a guy who said *not* to buy it at $30 "an idiot." The jury would deliberate for 5 minutes, and the only reason it'd take that long is that it takes 5 minutes to pick a foreman.

FYI, the entire gist of the suit is, IMO, there was one poster who was incredibly educated (not inside info or anything, the guy/gal was just extremely well-versed in the stock--he knew much more about ELN than CSFB's analyst and easily de-fused each of CSFB's "concerns" about the stock) and they (CSFB) wanted him silenced, because he made their analyst look like crapola. They got their wish, as he/she was one of the 2 who settled by agreeing to not post anymore. So CSFB won, basically. Which is sad, because whoever this person was, they really knew their stuff about ELN...thereby opening the door for numbnuts like Maris to spread more half-truths (oops, I guess I'm gonna get sued again...).
