Charles, both of them were my opinions, not shared by Microsoft or the govt, obviously.

For both parties, it would be prudent to settle if the case goes to appeals court. It is just that the govt has no reason to settle right now. They have been handed victories every time. So if the case goes to appeals court, they should settle instead of dragging it out - they should play percentages, that's all.

Microsoft thinks that it has a better chance to win in appeals court. It is willing to take the risk of dragging it out for a long time because of that. I think that Supreme Court review is not bad because I believe that govt has no case, has been thinking about the past and not the future. They exhibited the same behavior in WCOM+Sprint. imho, there were reasons to block it, but not the ones us govt was worried about - long distance!!. But this is not a question of my survival, it is Microsoft's. Because of that they want to go the appeals court route to improve their chances of winning.
