The PTO action is not yet a final determination, as Sibia still gets a chance to respond to the PTO's preliminary decision. However, it is highly likely that the PTO final decision will accord with their preliminary decision. (see RCMac's excellent analysis earlier on the thread).

It is tempting to speculate whether any of the judges here snuck a look at the PTO action. <g>
