Thanks for the opinion and the joke.

Although Lexar may be trying to buy time with this latest suit it is clear that October is approaching fast. To try to leverage a more favorable settlement before the October trial date is probably futile given the lack of substance in the filing. Simply put, SmartMedia is not a SanDisk product. But what conceivable mechanism is there patent infringement?

I think you are correct about the inconvenience of the Delaware venue. My alternate theory is that the Lexar lawyers were to embarrased to show their faces in the Northern California District Court and the risk was too high that Judge Breyer might end up reviewing the merit of the case.

Lexar is in a world of hurt. As Mike G. has posted recently, SanDisk appears to have been given the opportunity to expedite its review of Lexar's redesign. This would have otherwise required a labor intensive reverse-engineering of the new controller firmware. It also allows SanDisk to get an eyefull of Lexar's engineering strength and to formulate an opinion as to the feasibility of the design around. SanDisk's actions in the next few weeks will be interesting to watch.

Finally, I would think that Lexar could have showed more creativity and inventiveness in drafting the latest suit against SanDisk. From my point of view the premise is laughable.

If Eli and Co. do end up having to jet to Deleware often they should take the time to take a quick shuttle to NYC to meet with Analysts as often as possible.
