David- Actually, the significance of the October date is to allow a full deliberation by the court when this year's session begins Sept 25. I believe that they consider this case important enough to warrant a complete review of the fast track request. The delay is between the fast track Supreme Court June 2001 and normal track Appeals Court June 2002. IMHO the operative 'C' word (Competition) gives the edge to a fast track June 2001 decision by the Supreme Court. Looks like we're heading to test the softies option price (67 5/8). Harvey
