Monday September 25, 3:23 pm Eastern Time Press Release Jury Upholds Seachange MediaCluster Patent Against nCUBE Unique Video Server Architecture Presents Significant Advantages for Interactive Television and Other Video Delivery Application MAYNARD, Mass.--(BUSINESS WIRE)--Sept. 25, 2000-- Today in Delaware District Court a jury unanimously rejected nCUBE Corporation's challenge to SeaChange International's (NASDAQ: SEAC - news) MediaCluster patent. The decision reaffirms the validity of SeaChange's patent on this unique and strategic video server technology. Based on the jury's verdict and earlier rulings of the court, SeaChange will ask the court to enter a judgment of infringement and a permanent injunction against nCUBE's MediaCube-4 video server. The amount of damages to be awarded to SeaChange will be decided in further proceedings before the Delaware District Court. SeaChange will also seek a ruling that nCUBE's infringement was willful, entitling SeaChange to enhanced damages and attorneys' fees. SeaChange filed suit against nCUBE for patent infringement in June of this year. Today's jury verdict confirmed that SeaChange's U.S. Patent No. 5,862,312, which was granted on January 19, 1999, is valid. Earlier in the proceedings, nCUBE unsuccessfully contested the definition of certain terms in the claims of the MediaCluster patent. After Judge Joseph J. Farnan, Jr. rejected nCUBE's arguments, nCUBE conceded that its MediaCube-4 video server infringes under the definitions adopted by the judge. ``We are very pleased that the court has upheld the proprietary value of our MediaCluster architecture and validated the innovation and hard work of our employees,'' said Bill Styslinger, president and CEO, SeaChange International. ``MediaCluster poses tremendous advantages for a wide array of interactive video applications. SeaChange will continue to extend its leadership position in digital video systems through our technology and the strength of our organization.'' SeaChange's MediaCluster is a unique digital video server architecture comprising computer software and hardware to provide a proven fault-tolerant and highly economical means for the storage and simultaneous delivery of multiple broadcast-quality digital video streams. Among MediaCluster's principal benefits is that only one copy of video material is stored, thereby dramatically reducing storage requirements while guaranteeing the availability of all video at any output rate. Further, storage and service bandwidth capacity can be increased while the system is on air, recording and playing video streams.
