A 30 year old mother of three went into a hospital for a routine appendectomy. During the operation, the anesthesiologist went to make a phone call (malprctice in and of itself), and an inexperienced practical nurse didn't notice that a tracheal tube had moved up effectively strangling the patient, and leaving this vibrant woman with brain damage including total loss of vision and hearing, and a limited ability to speak or reason. It was proven that the patient's HMO had refused to approve the hospital's use of a certified registered nurse anesthetist in such procedures due to "expense." The patient sued, but her damages were capped at $150,000 due to her state's tort reform laws. Fair?

"Back in '87 I had my wrist crushed by a rank horse. A lawyer contacted me about suing the doctor who did the fixing. He said any cast is worth $10,000 in malpractice. Naturally, being a conservative, I told him no. Just didn't make sense."

This is a lie. It is not even close to the truth (otherwise all attorneys would have retired years ago, flush with cash).

"Same lawyer won a $20 million against GTE, family sued. A guy who was way over drunk and going way over the speed limit hit a pot hole and lost control over his car. While the car was doing an end over he got tossed out, not wearing his seat belt, and lost his head to a guy wire on a right of way. It was overturned"

This is may or may not be a lie. It is hard to tell, until you have the specifics of the case.
