Re the poster who advocates all punitive damages going to the state: What possible motivation would a lawyer and his client have in such a case to go after punitive damages? None whatsoever. In fact, the lawyer and client would be shooting themselves in the foot by even ASKING for punies, because the jury might decide to reward punies instead of awarding higher comps.

PS: I know I said my previous post would be the last one, but it depends on how you define "last."
