Think again, lawsuits of all kinds are now part of the online message board community. We are all familiar with civil actions from the SEC and lately from companies against online posters. Now we also have online posters suing each other. Some in the online community felt that hiding behind an alias was a green light to say just about anything. But, it is now clear that just like in other aspects of society posting messages on the Internet does relieve one of the scrutinies of whether the messages are accurate or libelous. Richard Marchese, as reported in The Wall Street Journal by John Emshwiller, filed suit against Gary Dobry, who used the online alias “Pugs”. The article stated: “The complaint alleged that Mr. Dobry used hundreds of Internet messages to "falsely and maliciously accuse" Mr. Marchese of "securities fraud, assault, and affiliation with organized crime." Mr. Marchese is seeking more than $75,000 in damages and an injunction against Mr. Dobry.” I have had the pleasure of reading a few of Gary Dobry’s posts on Raging Bull. Some where quickly removed because of extreme vulgarity. I found the need to express opinions in such a matter on a public financial message board rather interesting. The suit alleges that Dobry posted several messages relating to Marchese’s ties to organized crime, which he denies. Online personality Janice Shell was also mentioned in Marchese’s suit in reference to posts that Dobry had written about her. Mr. Emshwiller went on to say: “Mr. Marchese's suit quotes several online message from Mr. Dobry, including one which told Ms. Shell that "your ties to organized crime are in stone, evidenced by ... your working relationships with ... Rick Marchese." The article also stated: “In an interview, Ms. Shell, who is an art historian in Milan, vehemently denied being part of any manipulation or organized-crime group. She acknowledged having communicated with Mr. Marchese, though she said the two have never met”. Ms. Shell described Mr. Dobry’s posts as “vile”. I would tend to agree that some were extremely vile. While reading online stock discussion boards, readers cannot help but notice the attacks and the derogatory comments posted on a regular basis. I think this may be a wake up call to many of the online posters who may mistakenly believe that they can post “anything” online, whether true or false, without the possibility of repercussions. otcnn.com
