In "Leviathan", Thomas Hobbes argues that the one right that one cannot surrender to the sovereign is the right of self- defense. The very rationale for surrendering other rights to the sovereign is the long term improvement of one's lot through the social contract. It would be irrational to give up the right to defend one's person in the course of trying to improve one's lot. It would merely invite depredation.

Along with the right of self- defense goes the right to determine what is sufficient for one's defense. The Supreme Court recognizes limits, as with automatic weapons, where there is no reasonable relationship between self- defense and the firepower employed. But apart from these "overkill" limits, it should mostly be up to you what you need, so long as you are not a convicted felon........
