I don't think that this is the point. Whittington clearly manipulated the stock price and this alone should justify a SEC investigation. Of course you could have profit from his manipulation as he did but then your timing must have been perfect. The main problem is that he used false claims and rumors (read: FUD) to drive people out of the stock just to buy it himself cheaper.

If you were on the "list" who acted prior to the downgrade and upgrade. All you really need to be is a cynic and know a little about the tech sector and Technical Analysis.
