VIA doesn't make the chips only the boards. They have a cross licensing agreement with INTL through SIII (a joint venture with siii).

If they are using chips in violation of RMBS patents (say MU chips and MU hasn't licensed from RMBS) and RMBS prevails in its suit against MU then VIA would be prevented from selling the mother boards utilizing the non RMBS chips.

However they could utilize Toshiba or NEC (both I believe license from RMBS) DDR DRAM chips.

Not a complete answer but a start & RMBS needs to win the DDR suit.

Misheldo, I see you already received some very good response. All I can add is that did not study the patents in detail. The few claims I did analyze, related to memory and methods of communication between memory and other devices, I do not think that they cover systems utilizing their IP.
