Washington, Sept. 21 (Bloomberg) -- America Online Inc.'s buyout of Time Warner Inc. has been
recommended for approval by Federal Communications Commission staff, if the companies open
their cable lines to rival Internet services, the Washington Post reported, citing a draft report from the
agency's staff.

The merger would create a ''powerful duopoly'' through which Time
Warner and AT&T Corp., the two largest cable companies, could
coordinate their business strategies, the staff said in the draft,
according to the paper. The draft concludes that a condition allowing
Time Warner customers to choose their Internet provider would
prevent collusion with AT&T, the paper said.

The draft is an early look at the FCC's thinking about the merger and
the review is not complete, the Post reported, citing unnamed
sources. The commission could still move to block the merger if the
companies do not accept substantial conditions, the paper said. FCC
has given its staff until Oct. 12 to issue a final recommendation to
Chairman William Kennard, the paper said.

Attorneys for the Federal Trade Commission, which is not as far along
in its review of the merger, have said they are prepared to block it if
America Online and Time Warner do not guarantee that competitors
have access to Time Warner's high-speed cable lines, the paper
