Someone correct me if I'm wrong. The TD-SCDMA system derives from broadband CDMA patents cross licensed by QUALCOMM and INTERDIGITAL COMMUNICATIONS, as a result of a settlement agreement over a patent suit by IDC against Q. I believe Irwin Jacobs has commented on various occasions that this "flavor" of CDMA nevertheless uses proprietary technology still owned by QUALCOMM and therefore, that the system could not be operated without royalty payments to QUALCOMM. As far as I can determine, the reasoning behind Jacob's point of view has to do with the fact that the patents permitting broadband CDMA are so primitive, relatively speaking, that any up-to-date system would have to incorporate technology owned exclusively by QUALCOMM. Thoughts, anyone?
