The National Post reports in its Friday edition that Wi-LAN has confirmed
that U.S. federal regulators declined an application by the high-speed
wireless communications firm to certify one of its products as early as
last May, but the company only disclosed the information on Sept. 15. The
Post's Carol Howes writes that Hatim Zaghloul, Wi-LAN's chief executive,
said the decision was not made sooner because the firm was confident it
would win approval after a "petition for reconsideration" was filed to the
Federal Communications Commission on May 26. "It wasn't material in our
view," he said. "Management makes decisions on material events on a daily
basis." According to a letter from the FCC, the petition for
reconsideration was filed by Wi-LAN was denied on Aug. 17. The Sept. 15
press release explaining the denial made no mention that Wi-LAN had already
been turned down twice. Also, on Thursday, in what is considered rare by
industry standards, Mr. Zaghloul responded to concerns by investors on a
popular chat line, saying the application's rejection has made the company
refocus more of its resources on larger markets.
