I'll bet there's some intense pressure happening up in Yonkers. As ceoa+ described in forthright terms on RB, there is no product yet to market. It's a shame that Hirschman suggested (twice before) a time frame for IND submission, both of which did not make the train leaving the station.

Those particular 'suggestions' regarding a filing in mid-year 2000 most likely were ALSO a result of pressure being placed on the company both by shareholders and financial backers who are looking at their cash sitting still doing nothing. That Hirschman finds himself in a pressure cooker I blame some on him, some on the company's press releases, and also on the FDA which I still blame after this am's news re: expose'.

There is no rightful reason this process to move into testing should be taking this long.

A couple of other thoughts concerning today's interview:

1. It almost seemed that Dr. Hirschman was addressing ceoa+ directly when he mentioned that ADVR does have a business plan.

2. Dr. Hirschman also mentioned that he feels, by the action of 'wall street', that it appears 'wall street' does not believe what he is saying about the new pharmacology and science ADVR is engaged in and basically does not believe in the company's ability to execute their business/scientific plan. [I am sure that every lurker/poster has a reason why this apparent investing public attitude or disinterest is occurring at this time.]

The N.Y. court litigation has been dismissed, as you thought.

In September 2000, our case in New York was dismissed. We are
considering requesting that the New York court reinstate our claims in the New
York case. The case in the federal court in Detroit continues. At this point, we
have answered the complaint against us in the federal court in Detroit and have
entered a number of counterclaims which are in substance the same as our claims
in the New York case.


Advanced Viral believes that the allegations contained in the
Defendants' complaint are without merit and Advanced Viral intends to vigorously
defend itself against all allegations contained therein.
