Saying that it is illegal to defraud people is like saying that when it is raining it is wet outside.

The question is, when are you defrauding people, and when are you guilty of mere "puffery" (i.e., what brokerage houses and journalists do every single day).

I don't have to be your broker, nor have a fiduciary relationship with you in order to lie to you to enrich myself and relieve you of your money. You may be smart enough to prevent that, which is good. Or you may not. In either case, what I would be doing is wrong. My integrity prevents me from doing so. Lebed's does not.

On your last point -- John wasn't just "cheerleading" with simple "optimistic opinions". His posts were calculated to instill a false perception of credibility, and were otherwise riddled with outright lies.
