Thanks I forgot about the quiet period. My frustration has overcome my ability to reason.

Watching this stock has been extremely painful.

You wrote - "Earnings are coming and they are in the quiet period required by the sec. They are not permitted to say anything even IF they wanted to."

At least they didn't pre-warn!....so that might be a good sign.....ANON

not totally quiet unless there is some material events:upside or downside suprise. If there is no pre-announcement, then chances are LU will meet or exceed estimate. If LU wouldn't meet, it would have warned by this Fri. as it wouldn't upset the financial community the 3rd time this year. Captain, Thursday is a good date to buy. LU + AV would go up next week after window ressing is over and no warning. It's an easy double when the ME + Opt spin-off take place early next year.

Captain Jacki, RE: Earnings are coming and they are in the quiet period required by the sec. They are not permitted to say anything even IF they wanted to.

That is not true. I've said it a few times, but I need to say it again:

There is no quiet period before earnings required by the SEC. Any quiet period is self imposed by the company. They are fully able to reiterate old guidance or issue new guidance if they so desire.

One thing that they are required to do by the SEC is say something if they are in possession of material facts that would affect the stock price. This would include an indication that earnings would be far away from current expectations if Lucent was instrumental in driving those expectations. Given that there is still no warning from LU management, that would indeed be a good sign.

That doesn't guarantee that earnings won't come in below expectations, mind you, but it increases the probability.

Captain, Just a hunch here from me, but I get the feeling that LU may go to a buy signal tonight the way things are shaping up so far today, so I may buy some here anyway even though the "official" buy signal has not yet arrived..... Yogi
