In fact, as far as I know, pre-announcement aren't mandatory (ie law), either way (upside or down). Big misses are more appropriate for using them, where values are very skewed from concensus.

The SEC requires that a company announce with 24(?) hrs any news of a material nature that will move a stock.

An EPS shortfall, I believe, falls into that category.
