Pat: The Hitachi and NEC agreements, if written like most license agreements, will govern anything made at their respective fabs, whether oem'ed (to the new entity) or not. If one of them takes a majority position in the NewCo, then their agreement with the bus will take precedence over the new entity, at least until renegotiated. If 50:50, a new agreement will be forthcoming before start-up of fabbing by the new entity. JMO's
