I agree.. But the stock has been halfed and has products in the pipeline which is necessary for growth. You might see a cautious Q4 comment, but I don't think so as they would have released that info already. I think growth funds are dumping this and value funds are picking up the pieces. This is an 80 spot, more than that is doubtful unless the sc thing is totally cleared up. Too many upgrades in the past 3 weeks for bad news in the earnings release. I covered at 58 3/8. Too risky to short now. Could go a couple of bucks, but if MSFT announces a settlement, shorters balls will be fried.

And johnd scared me when he mentioned that they didnt file the paperwork which leads me to believe they are talking.

Bearish as I am on MSFT, I don't expect them to disappoint. MSFT's accounting has an amazing amount of room for fudging their numbers. You could see last quarter that they had to use a little bit of that flexibility. I fully expect them to meet expectations, but watch for them to have to cash in more investments, to start to claim depreciation on their software assets, and to hide some of their losses behind pro forma numbers.

If there are any good analysts left in the business, they will be looking for this kind of shenanigans in MSFT's report, and they will tell you about them. But don't hold your breath waiting for that to happen; I think those guys have all been replaced by talking parrots in little cheerleader outfits.
