CHARTER'S DIGITAL PACTS

'Disco' device would record, store content

NEW YORK -- In a deal that could be the first step toward bringing
digital video recording technology into the mainstream, cabler Charter
Communications has inked a pact with Motorola, ReplayTV and private
equity firm Vulcan Ventures to develop a set-top digital cable box with
built-in digital video recording.

The proposed device, dubbed "Disco," will integrate the ability to record
and store digitally video, audio and Internet content.

The technology is based on ReplayTV's own stand-alone digital video
recorder, which allows users to pause live television and record shows
digitally for playback on demand.

The box has been the subject of some controversy among broadcasters
and TV advertisers over its ability to skip over recorded commercials.

Expansion seen

Integrating that technology with a digital cable box will help Charter
broaden its content and set the company up to expand into new
broadband-based offerings, said prez-CEO Jerry Kent. "Disco will benefit
the entire cable television industry by integrating (digital video recording)
functionality into advanced digital set-tops, creating a more robust platform
for future services, and allowing new applications."

If adopted, the new boxes also could expand the installed base for digital
video recording technology. Charter boasts 6.3 million cable subscribers in
more than 40 states.

The combined installed base for all stand-alone digital video recording
players, including those of Replay and its rival TiVo, is expected to reach
300,000 by the end of the year, a Replay spokesman said.

Charter said Motorola will contribute hardware for the set-top project,
and Replay will pony up its proprietary digital video recording software.
Both Charter and Vulcan Ventures are controlled by financier and
Microsoft co-founder Paul Allen.

My favorite Phoenix type stocks would be BEAS, GMST, NTAP, QCOM, and SEBL.

Finally got on SI today. Pretty much sittin' tight and letting the washout run its course with a few small adds. Somewhere along in here we will cross the line from freefall liquidations to the MOABO, imo...trouble is, we won't know for sure until it's already happened!

Best gains, as in previous tech bottoms, will be in beaten-down superstars like JNIC, SCMR, LPTH, CMGI, NTRO, etc. For those who can afford it financially and emotionally, some preemptive nibbling on previously unaffordable flyers may be warranted. Of course, the opportunities could be even better tomorrow but I wouldn't (and haven't) bet completely on prices going drastically lower from here, Naz 3370 (especially on strong companies like AOL, JDSU, QCOM, etc.).

Phoenix candidates. This is an ice cold list, inasmuch that I know very little, if anything about the companies. It is a result of a mechanical search of >$20 stocks that have increased by more than 20% since 1 September...also, the list is by no means conclusive.

SDS 45 +25%
OTGS 44.5 +100%
CAMZ 34.75 +111%
ACXM 33.5 +31%

Hope this can contribute to finding our pot of gold.....
