The term "open, proprietary technology" means that a Gorilla can license use of its patents without jeopardizing its genetic heritage.

True, but at some point the terms of the license can become so broad that it is akin to ownership. E.g., were Dr. IJ to put his considerable brain on hold, QCOM might grant an exclusive right to all its IPR to Nokia. Were that the case, there would be no role left for QCOM.
