The tort reform we need is in the area of damages and perjury. The court should appoint at least two neutral experts who have no previous ties to the defense or prosecution. Expert witnesses should be subjected to searching expert cross examination. I am in favor of polygraphs. Since experts are in it for the fees they should be willing to stand the gaff.
People who lie (fake injuries, mental distress, etc.) should be fined very heavily and lose their cases. Lawyers who suborn perjury should be disbarred.
Lawyers who file frivolous cases should be heavily fined, three strikes and out.
Tort cases should be tried before a three judge panel without a jury (a constitutional amendment).
