You hit the nail on the head as usual...
The arguement is circular...if cigs aren't bad enough to ban, and people smoke them of their free will, why should Lawyers be allowed to sue? If Cig companies are so criminal, why are cigarettes legal? The whole governmental stance is very hypocritical.

This of course is a double edge sword. You then create a black market, smuggling problem that must be enforced.
OTOH, a high cost of cigs would be a major deterent.
