When you get "spin off shares" - AV in this case, is it considered as "capital gain" even though you don't sell for the yr? or is it like "split" ? TIA


I do not know the specific answer to that since I do not own any shares of Lucent, so I have not paid any attention to the issue, nor done any research.

I have read (without detail), that the IRS has issued a private letter ruling in which case Lucent must at one point communicate with you, the shareholder, to formaly inform you of the treatment as per such letter.

Read the thread there are a number of messages to that effect. In any event, I am not neither a Tax accountant nor attorney so I would not even venture expressing an opinion. If I were you I would:

1. Check with my own tax accountant or attorney

2. Check with Lucent as to the IRS letter to see the specific treatment

It's a tax free distribution - the details have been posted on the thread a while back - check my posts about 3 or four weeks ago, I posted the relevent excerpt from the proxy, which is also on the corp. site.
