I'm a death penalty proponent. And I don't agree that the purpose of a hate crime law is deterrence or that it would have that effect. As you noted it is impossible to claim the death penalty for capital murder has had any effect as a deterrent. That you trivialize these crimes by using hair and eye color examples is sad.
