Well it looks like from the news reports that this will be considered by the SEC, an illegal dissemination of information also, under reg FD. ~"ALL private discussions" seem to be prohibited. This makes sense, if the company can't say "our earnings are $.12" they also can't say, well its smaller than $.13 but bigger than $.11. This is very good news for individual investors.
