Elpida may be a legal entity but without any product till Jan 1st, who cares. The timeline is sometime before the end of the year they need to have licenses already in place to produce their products starting jan 1st. If jan 1st comes and there is no licensing announcement, then we talk again. Till then, you are FUDing, as usual, 75 days too early.

And given this recent article, them signing is only a matter of time before Jan 1st.
