willcousa...if it is proven that dell has sold one machine, then the nexus is established. two sides as i previously stated to establishing jurisdiction. the fact that they sold into a jurisdiction beyond texas, does not preclude action being taken by a non texas entity. how many corporations are sued and must stand trial in a state court that is not the place of incorporation? were all the state attorney general actions against msft or tobacco companies ignored by these companies? they had to defend in the states, without protection of their incorporated state.
