For how long does a stock not have to trade before one can declare a capital gains loss? I
Is there some law on the tax books about this?

Your comment on the surface would seem to be correct. However,I think Hood has, in fact, done at least a yeoman job on the engineering and production side. The company is producing largee quantities of product and is bringing new PM into production, although not without problems. Manufacturing seems to be in good shape--although there would appear to be still room for improvement. PM-6 has had some problems. PM-5 had huge start-up and QC problems, but it is now running so efficiently that PM-1 is not needed for AR product. I understand PM-1 is now used as a standby machine. Note that PM-1 cannot manufacture the high margin XIR film for autos.

The real problem was that Hood relied on the financial side on Finley, who turned out to be incapable or worse. Hood deserves criticism for not addressing this problem sooner, but I do not agree that it would be in the interest of the stockholders to change CEO horses at this time.

The company now has a strong QC program in place in Palo Alto. I assume some similar program has been implemented in Tempe, but do not know for sure. Obviously there was an inadequate cost accounting program in Tempe.
