I would argue that the Al Sharptons of this world exist because people do not feel they are fairly protected by the law. Racists, or sexists, or religious bigots, or homophobes will breed in a free country no matter what- because some people just really want to hate other people. And that's allowed in a free society. What gets dicey is trying to signal our VERY firm societal intention that hate not be acted upon. I think having special rules about hate crimes signals this intention. And it clearly embraces crimes against ALL races.

Quite frankly the statistics show favoritism to whites in the criminal system. And the real and perceived inequality of treatment causes miscarriages of justice like the Simpson trial. I'll be happy to post you some very well done studies if you'd like some.
