Shootist, you idiot, I provided a verbatim quote of the applicable federal statute (it is the IRC, not a regulation, you dolt).

Re inheritance taxes, there may be a few states out there that still have them, but the vast majority of the states use a "pick up" estate tax that provides them with an amount equal to the federal estate tax credit for state death taxes.
