Re example (1), you are correct, the prom. note will probably require lender's permission to change title (or you could simply not record the deed until after death, if your state allows that).

In example (2), I have never had that issue come up, I guess the credit cared company could sue the estate or the new owners, but since the grantor isn't actually defeased of title until after death, I don't think it is a fraudulent conveyance unless he knew he was dying (otherwise many garden-variety probate avoidance measures would be problematic).
